Banning guns or weapons on private or public property assumes a legal duty to protect occupants by the property owner. It also assumes liability for injury from crime.

Putting property owners/agents on notice that banning self-defense weapons is extremely dangerous helps when cases go to court. If the property owner fails to take good faith steps (remove the signs/policies, hire the appropriate number of armed and trained guards in addition to having security screening, etc) then it looks terrible in court. They were, on record, made aware of real issues. They failed to act upon those issues. Someone, unfortunately but unsurprisingly, was injured due to criminal activity.

Next, we document and publish the notice. We track the progress and changes in policies or signage. If no change occurs, we document that as well. We make this information available to the public for easy search and download.

We also may, at times, reach out again to the legal entity responsible for the dangerous “no weapons” policies.

Part of the battle is finding injured parties to file suit. By banning self-defense weapons, property owners accepted and voluntarily assumed the duty and liability for protection. Obviously signs and policies don’t stop criminals, so with those signs and policies must be other action items such as armed guards, security screening, and other real and tangible efforts. Since there is a known increase in risk – the signaling to criminals that this property has disarmed targets – in posting signs, property owners must take proper action to mitigated this known risk.

Were you or someone you know hurt in a “gun free zone” or other area that has a policy and/or signs against carrying defensive weapons? Please contact us immediately! These facts must be stressed and focused-upon in court by your attorney. The property owner didn’t have to adopt the policy or post the sign, they did so voluntarily and assumed the liability for injury even more than if they had just left it alone.

As cases reach courts and juries, property owners will quickly see that these hollow do-nothing and hazardous signs/policies are a major liability. They will not want to, due to expense, hire the appropriate number of armed security guards needed for the number of occupants they have. When not backed-up with real physical security – the appropriate number of armed guards – these policies do nothing but increase danger and liability for businesses.

As such we will see the signs and policies disappear all over the United States (and perhaps beyond) rapidly. This will be faster and more efficient than any other approaches to solve the ongoing serious problem of establishments signaling to criminals to come commit crimes.
